License suspended, revoked or denied? The appeal clock is running.
There is generally a 90-day window to petition the District Court after an LTC suspension, revocation or denial under G.L. c. 140, § 131. A restraining order can require you to surrender firearms and licenses immediately.
What we defend
- Unlawful possession of a firearm
- Carrying a loaded firearm; ammunition offenses
- Possession without an LTC or FID card
- Large-capacity weapons and feeding devices
- Improper storage and transportation
- Charges arising from motor vehicle stops
- Ghost gun and unserialized firearm charges
- Armed career criminal enhancements
- LTC suspensions, revocations and denials
- Firearm charges combined with drug or other offenses
The defense often turns on the stop and the search
Article 14 of the Massachusetts Declaration of Rights and the Fourth Amendment limit when police can stop, frisk and search. When a search crossed the line, we move to suppress the evidence. We also test whether the item meets the legal definition of a firearm, including whether it actually works, whether you knew about and controlled it, and what the licensing records really show.
The U.S. Supreme Court's Bruen decision, recent Massachusetts appellate rulings and the 2024 firearms reform law (Chapter 135 of the Acts of 2024) are reshaping these cases. We track every development.
What's at stake
- Mandatory minimum sentences
- A permanent, possibly felony, record
- Loss of LTC and FID; federal prohibitions
- Forfeiture of firearms
- Immigration consequences
- Careers in law enforcement, security or the military
