A real defense starts with the evidence
Drug cases often turn on a few questions: why police stopped you, whether the search was lawful, who the drugs actually belonged to, and whether the Commonwealth can prove the substance and its weight. Article 14 and the Fourth Amendment limit searches, including searches based on the odor of marijuana. In shared cars and homes, the prosecution must prove knowledge and control, and inferences of intent drawn from cash, phones or quantity can be challenged.
Massachusetts has seen serious drug lab misconduct. We review certificates of analysis, weighing methods and chain of custody in every case.
What's at stake
- Mandatory minimums for trafficking
- Enhanced school and park zone penalties
- Incarceration and a permanent record
- Immigration consequences
- Loss of licenses and federal student aid
- Civil forfeiture and firearm rights
